Wedding photography contract

Updated October 17, 2026

A short, plain wedding contract: coverage, payments, overtime, cancellation and image rights.

Wedding photography contract

This contract is between the photographer named below ("the Photographer") and the two people named below ("the Couple"). It takes effect when the Photographer and both partners have signed it.

1. The day

Photographer or studio name
Partner one: name, email and phone
Partner two: name, email and phone
Wedding date
Ceremony time
Ceremony venue
Reception venue
Coverage hours (start and end)
Package and what it includes

2. Fee and retainer

The total fee is $. A retainer of $ is due when this contract is signed. It is non-refundable and is applied to the total fee. The date is held only after the Photographer has the signed contract and the retainer.

3. Payments

The remaining balance of $ is due days before the wedding. If it is late, the Photographer may charge a late fee of $ and may treat the contract as cancelled by the Couple.

4. Overtime, travel and meals

If the Couple asks the Photographer to stay longer and the Photographer is free to, overtime costs $ per hour. Travel beyond miles is charged at $, and the Couple pays for lodging if the Photographer must stay overnight. If coverage is longer than six hours, the Couple provides the Photographer with a meal and a short break.

5. What the Couple provides

The Couple sends the Photographer the day-of timeline and a list of family groups by . They name one person who can answer the Photographer's questions on the day: . They also tell the Photographer about any venue or officiant rules on photography, and ask guests not to block the shot. The Photographer is not responsible for photos missed because of these.

6. Cancellation and changes

If the Couple cancels, the Photographer keeps the retainer. If they cancel within days of the wedding, the full fee is due. If the Couple moves the date, the Photographer will move the booking when free on the new date. Otherwise it counts as a cancellation. If the Photographer cannot attend because of illness or an emergency, the Photographer will find a replacement of similar skill or refund everything paid. Neither side is responsible for events outside their control, such as severe weather or a government order.

7. Equipment and backups

The Photographer brings backup equipment and saves the images in more than one place. If something still goes wrong, the most the Photographer owes is a refund of what the Couple has paid.

8. Photos and delivery

The Photographer chooses and edits the images in their own style, and delivers them in an online gallery within weeks of the wedding. The gallery stays online for months, so the Couple should download and back up the images in that time. Unedited files are not delivered. Albums and prints are not included unless the package says so.

9. Copyright and use

The Photographer owns the copyright. The Couple may print and share the images for personal use, and may give them to their wedding vendors, but may not sell them or use them for advertising. The Photographer may show the images in their portfolio, website, social media and in publications. If the Couple does not allow this, they write their initials here: .

10. The whole agreement

This contract is the whole agreement. Any change must be in writing and agreed by both sides. It is governed by the laws of the State of .

How to use it

  • Fill in the blank lines, and check that the hours and prices match your proposal exactly.
  • Choose a final payment date and an overtime rate you will really enforce.
  • Delete any line you do not need, such as travel or meals, rather than leaving it blank.
  • Hold the date only when you have the signed copy and the retainer, and keep the signed copy with the couple's record.

Questions

Should the retainer be refundable if the couple changes the date?

Most wedding photographers keep it, and move the booking if they are free on the new date. Say clearly what happens in each case so there are no surprises.

When should the final payment be due?

Two to four weeks before the wedding is common. That way you are paid before the busiest weeks, and the couple is not paying on the day.

Do I need a separate contract for a second photographer?

Yes, with the second photographer themselves. It should cover their pay, who owns the photos and what they may post. This contract is only between you and the couple.

Do I need to deliver the unedited files?

Most wedding photographers do not, since the edit is part of the work. If you do sell them, price them separately and put that in writing.
